The following Terms and Conditions apply for the business relationship and constitute a legally agreement between the user and Lara Prasseur (throughout the site referred to as “we”, “us”). We advise that you read the terms and conditions before placing an order in our online shop.  By accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Use. By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence. We reserve the right to update, change or replace any part of these Terms and Conditions at any time without notice. It is the customer’s responsibility to regularly consult the Terms and Conditions. In addition, we may exercise its rights on any occasion on which you violate these Terms and Conditions.

 

  1. Payment Authorization

You agree to provide correct information on personal details such as name, telephone number, e-mail address and other required information. We retain the right to refuse service to anyone at any time for any reason. In addition, you understand that information about your credit card number or credit information may be transmitted or obtained by third parties in case it is necessary.

You understand that the personal information that you provided, if necessary, may be communicated to one of our payment processing partners, a credit or fraud prevention agency. This may be necessary if needed to confirm your identity, to validate your credit card, to obtain a first credit card authorization, and to authorize your individual payment transactions.

We do not store any information regarding your credit card details.

 

  1. Terms of Use

You may not use Lara Prasseur for any other purpose than the one for which we made it available. You agree not to use Lara Prasseur in a manner that can interfere with security related issues, that are damaging or that are impairing access to Lara Prasseur, or for fraudulent purposes, in connection with a criminal offense or illegal activity. In addition, each user is required to not post content or submit messages that are: immoral, racist, pornographic, offensive, untrue, violating the rights of third parties, in particular, copyrights, violating applicable laws. As a user of the site, you agree not to upload or transmit viruses, or any other material that contains viruses or computer programs that could interfere with the use, features, functions, operation or maintenance of the site or that damages software or hardware. You agree not to use any content or part of the site for any revenue generating or commercial enterprise endeavor.  You agree not to use any content from our site in order to advertise or sell goods and services. You agree not to copy or adapt the site´s software or any other code.

We reserve the right to delete published comments and contributions posted on social networks (Facebook, Twitter, Instagram, TikTok, etc.) without stating reasons and without notice at any time. We have no obligation to maintain any comments in confidence, to respond to any comments or to pay compensation for any comments. You agree to provide only truthful, factual information that does not contain any defamatory content when reviewing orders. Lara Prasseur reserves the right to prohibit access to and use of the site, close user accounts, remove or modify content if it violates any applicable law, these terms of use or any other applicable Terms and Conditions or policies. You agree that we may edit, copy, publish, distribute, translate, use in any medium any comments that you forward us. In addition, we reserve the right to refuse any order you place with us. Restrictions concerning limitations of quantity or cancelation of orders will be notified by contacting the e-mail and/or billing address/phone number provided at the time the order was made.

 

  1. Orders and Returns

ORDERS

All orders made in our online shop are subject to availability and our acceptance. We strive to reproduce the colors, features, specifications and details of the products on our website as accurately as possible. However, electronic displays may not accurately reflect the actual colors and details of the products.  All products are subject to availability, and we cannot guarantee that items will be in stock. We reserve the right to discontinue any products at any time for any reason. Prices for all products are subject to change. Occasionally, due to production issues or quality controls, we may be unable to deliver some products at the time of your order. If this happens, we will contact you immediately by e-mail and refund the originally debited amount to your credit card within 30 days of confirmation of the non-deliverable product.

PRICES

The prices listed on the website are indicated in the currency displayed. Unless otherwise indicated, the price includes VAT. Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

CONFIRMATION OF YOUR ORDER

As soon as you have selected your product via the “add to cart” button and submitted your order, this forms a binding offer for the purchase of the products in the shopping cart.

You will then receive an e-mail with the payment confirmation. This e-mail is NOT an order acceptance but only a confirmation of the receipt of your order.

The order acceptance and the conclusion of the contract between you and Lara Prasseur shall be deemed to have taken place as soon as we send you an e-mail with the order confirmation and tracking number. The sales contract is concluded in Zurich, Switzerland.

We reserve the right to refuse the order at our discretion. We are not liable to you or third parties due to our cancellation. In particular, we cannot accept the order for the following reasons: (1) In the event of non-authorization of payment; (2) in the case of a product which is not in stock or does not meet our quality control standards and must therefore be withdrawn; (3) You do not fulfil the criteria defined in these Terms and Conditions.

SHIPPING INFORMATION

All shipments are carried out by Swiss Post. The general Terms and Conditions of Swiss Post AG apply additionally and may be accessed at: www.swisspost.ch

SHIPMENT TRACKING

Once we have sent out your order, you will receive a notification via email including the post tracking number. You can check the shipment status after one to two hours at www.swisspost.ch. Enter your tracking number to track the status of your shipment. We cannot accept responsibility for any items that arrive damaged because of in transit maneuvering.

DELIVERY TIME

The estimated delivery times are displayed here and should be regarded as a guideline and start on the date of dispatch. We assume no liability for delivery delays.

The passing of risk begins with the time of the product arrival.

SHIPPING COSTS

The shipping costs are displayed during the online checkout and payment process. You can check our shipping fees here.

PAYMENT METHODS

We only accept the payment methods displayed to the customer during the order process. You confirm with the payment that the used credit card belongs to you or that you have a specific authorization from the owner. All credit and debit card holders are subject to validation and authorization of the card issuer. Should the issuer of your payment card refuse payment to Lara Prasseur, we will not be liable for any delays or non-delivery of the product. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site. You further agree to promptly update your account, including email address and payment method, so that we can complete your transactions and contact you as needed. Sales tax will be added to the price of purchases as deemed required by us. We may change prices at any time. All payments shall be in the currency specified on the Site. You agree to pay all charges at the prices then in effect for your purchases and any applicable shipping fees, and you authorize us to charge your chosen payment provider for any such amounts upon placing your order. We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment.

We reserve the right to refuse any order placed through the Site. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same payment method, and/or orders that use the same billing or shipping address. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

RETURNS

Orders can easily be returned within 14 days of receipt. Please contact us within 14 days after the reception of the items via email at hello@laraprasseur.com. All returns must be unworn, have no signs of wear or damage, in its original condition with tags still attached (if any), in all original packaging (box and pouch included). All returns must be packed safely by the customer for return. You agree that any jewelry items that have been tried on cannot be returned for hygienic reasons.

We cannot accept responsibility for any items that are stolen or lost in transit. We cannot accept responsibility for any items that arrive damaged because of in transit maneuvering. To prevent this, we would strongly recommend that you use a secure trackable courier service of your choice (FedEx, DHL , or UPS) to return your items safely to us. Please note that unidentified returns will be returned to the sender and will not be refunded.
The shipping costs for the return of unwanted items are to be paid by the purchaser or sender. You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.

Please check the received products for errors immediately after receipt. Products are faulty if they arrive damaged or have a material or manufacturer error. Customary or technically unavoidable, material-related deviations of the quality, color, size, or the design of the product are no defects. This also applies to natural wear. In addition, we offer no right of exchange.

If all these conditions apply, we will refund you the purchase price paid.

We will only process personal information in accordance with our applicable privacy policy.

 

  1. Applicable Law and Jurisdiction

Swiss law applies, excluding the UN Sales Convention (CISG). The exclusive place of jurisdiction, subject to any legally binding jurisdiction, is Zurich, Switzerland.

Failing to comply with these Terms and Conditions (including the Privacy Policy) may result in loss of membership and access to Prasseur.

PRIVACY POLICY

You agree to hold harmless Lara Prasseur and any affiliates, from either claim, demand or attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service. In no case shall Lara Prasseur or our affiliates be liable for any injury, loss, claim, direct or indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility.

COPYRIGHT INFRINGEMENT

You agree that in using and interacting with the Site, you may not modify, post, distribute, or reproduce in any way any of the content that is copyrighted material belonging to others, without obtaining their prior written consent. You agree not to use any content including text, images, logos or other graphics on the site without the written permission of laraprasseur.com. Lara Prasseur reserves the right, in its discretion, to remove any content if we believe it may infringe the copyright rights of others, and/or to terminate the accounts of users who we believe to be infringers.

 

  1. Gift Cards

Prasseur digital Gift Cards expire 1 year from the date of issue, after which it will be invalid and any remaining balance will become the property of Lara Prasseur. Lost or stolen cards will not be replaced or refunded. Cannot be exchanged for cash or refunded or used to buy another digital Gift Card, or used to make payment on a credit account, unless required by law.

Redeemable online at www.laraprasseur.com.

No change will be given, but the balance may be applied to future purchases. Digital Gift Cards can only be used to make purchases up to the initial Gift Card amount, or the remaining balance. If your purchase exceeds the balance on the Gift Card, you must pay the excess using another payment method. Goods purchased using the Gift Card are subject to Lara Prasseur´s exchange or returns policy. Where you are eligible for a refund, to the extent that you paid for goods using an Gift Card, you will be refunded by way of Gift Card. To check the balance or expiry date please visit My Account page in the GiftCards section. GiftCards amounts are issued in the currency of the store.
